Background

The Public Service Commission (PSC) is considering a Declaratory Ruling that, if granted, would allow third parties to own and operate solar generating equipment and storage facilities and sell electricity to the customer without being subject to normal utility regulation. This exemption, if granted, would put consumers at risk and would be detrimental to  regulated electric utilities and their shareholders.

Status

The PSC is considering two similar requests for Declaratory Ruling as Dockets # 9300-DR-105 and 9300-DR-106. They expect to act on the requests by early December 2022.

Action Requested

Please take a minute to submit comments the PSC and express opposition to the two Dockets. Please comment on each Docket. To comment on the Dockets, click on the links below or go to: psc.wi.gov and click on the “Public Participation” box, then scroll down and click on “File a Comment online.” Find the Docket number and click on “file a comment.” To send letters in the US Mail, address them to Docket 9300-DR-105 and 9300-DR-106, Public Service Commission, P.O. Box 7854, Madison, WI 53703-7854. All correspondence must be received no later than November 9, 2022.

Issues/Arguments

In your correspondence consider making the following points in your own words:

  • As a retiree, I rely on my utility stock dividends to supplement Social Security and other retirement income.
  • Regulated utilities will be adversely affected by competition from the nonregulated solar generating entities who do not have to pay for grid maintenance and other reliability costs. This could adversely affect my utility investments
  • Allowing third parties to own and operate solar generating equipment and sell to the customer outside of normal utility regulation could be harmful to consumers. Rate regulation and reliability requirements exist to protect consumers and should apply uniformly to all providers.
  • Since customers of the proposed nonregulated solar generation will remain connected to the grid, other customers, that do not participate, will be forced to pay a larger share of the cost of the distribution system.
  • Utility scale renewable energy generation is by far the most cost-effective way to deliver clean energy to consumers. Small scale distributed generation is inefficient and expensive.
